GENERAL TERMS AND CONDITIONS OF SALE

Article 1 – Identity of the Business

These General Terms and Conditions of Sale, hereinafter referred to as the “Terms”, are issued by:

VAT is not applicable pursuant to Article 293 B of the French General Tax Code.

Article 2 – Purpose and Scope

These Terms define the rights and obligations of L’Aube Parisienne and its customers in connection with bookings and purchases made through www.laubeparisienne.com, by email or by any other method accepted by L’Aube Parisienne.

L’Aube Parisienne primarily offers:

  • cultural and romantic experiences in Paris and the Paris region;

  • walks and private moments;

  • decorative floral arrangements;

  • breakfasts composed of products purchased from professional suppliers;

  • deliveries of flowers, breakfasts and surprises;

  • personalised services organised upon request.

The services offered do not constitute regulated guided tours, classes or professional training.

Every booking entails unconditional acceptance of the Terms in force on the booking date.

Article 3 – Characteristics of the Services

The essential characteristics, content, location, duration, price and available options for each service are described on the website or in the quotation sent to the customer.

The customer must review this information before confirming an order.

Photographs, illustrations and presentations are intended to represent the general style of the services. They are not contractually binding in relation to natural, seasonal or variable elements, including flowers, bakery products, pastries and decorative items.

Any substitutions must maintain a quality, value and general style comparable to those advertised.

Article 4 – Prices

Prices are stated in euros.

L’Aube Parisienne benefits from the French VAT exemption scheme. VAT is therefore not applicable pursuant to Article 293 B of the French General Tax Code.

The applicable price is the price displayed when the order is placed.

Unless otherwise stated, prices displayed “per guest” are calculated according to the number of participants. Some services may require a minimum of two people.

The total price, selected options and any additional charges are displayed before the order is confirmed.

L’Aube Parisienne may change its prices at any time. Price changes do not affect bookings that have already been confirmed.

Article 5 – Online Booking Process

The customer selects the service, date, time and available options.

Before final confirmation, the customer may review the characteristics of the order, its total price and correct any errors.

The order becomes final after:

  • validation of the order summary;

  • acceptance of these Terms;

  • confirmation of the order with an obligation to pay;

  • receipt of the required full payment or deposit;

  • issue of a booking confirmation by L’Aube Parisienne or the booking platform.

The confirmation is sent to the email address provided by the customer. The customer must verify that this address is correct and, where necessary, check their spam or junk-mail folder.

L’Aube Parisienne may refuse a booking in the event of unavailability, manifestly inaccurate information, suspected fraud, a payment incident or circumstances that reasonably prevent the service from being provided.

Any amount paid for an order refused by L’Aube Parisienne will be refunded.

Article 6 – Payment

Unless otherwise stated before the order is placed, full payment is required at the time of booking.

Accepted payment methods are those offered on the website or communicated to the customer, including secure payment through Stripe or bank transfer when expressly accepted.

Where payment of a deposit is offered:

  • its amount or percentage is stated before the order is placed;

  • it constitutes a binding deposit and commits both parties;

  • the amount and payment deadline for the outstanding balance are stated before confirmation and in the booking confirmation;

  • failure to pay the balance by the applicable deadline may result in cancellation of the booking after the customer has been informed.

L’Aube Parisienne does not have access to confidential banking details entered directly into the payment provider’s environment.

No service will be provided until all amounts due have been paid.

Article 7 – Experiences and Punctuality

Experiences are organised at the locations, dates and times stated in the booking confirmation.

The customer must arrive at the meeting point at the scheduled time.

If the customer is late:

  • for delays of up to fifteen minutes, the service may be maintained or shortened if circumstances permit;

  • after fifteen minutes, L’Aube Parisienne may treat the service as cancelled by the customer when it is no longer possible to provide it properly.

No refund will be due if the service cannot be provided because of a significant delay or the customer’s absence.

L’Aube Parisienne may nevertheless offer a change of date or another commercial solution.

Article 8 – Deliveries

Deliveries are made within Paris and the areas proposed or accepted when the order is placed.

The customer is responsible for the accuracy of:

  • the delivery address;

  • the recipient’s name;

  • the telephone number;

  • the agreed delivery time;

  • access codes, instructions and authorisations;

  • information necessary to make a delivery to a hotel or private establishment.

Where necessary, the customer must confirm that the hotel, residence or establishment accepts deliveries of food products and flowers.

If the address is incorrect, access is impossible, the establishment refuses the delivery or the recipient is absent, L’Aube Parisienne will attempt to contact the customer.

Where delivery has been attempted in accordance with the information provided, no refund will be due for prepared, personalised or perishable products. Additional charges may be requested before a second delivery attempt.

These provisions do not apply where the failure to deliver is attributable to L’Aube Parisienne.

Article 9 – Flowers and Substitutions

Flowers are natural, fragile and seasonal products.

Depending on the season, availability and quality of supplies:

  • certain varieties may be unavailable;

  • certain colours or species may be substituted;

  • the exact volume, shape and appearance may vary slightly.

L’Aube Parisienne may substitute flowers of comparable quality and value while respecting, as far as possible, the style, colours and spirit of the arrangement ordered.

Photographs do not guarantee a strictly identical reproduction.

Article 10 – Food Products and Allergens

Breakfasts may contain or may have come into contact with allergens, including:

  • cereals containing gluten;

  • milk and dairy products;

  • eggs;

  • tree nuts;

  • peanuts;

  • soya;

  • sesame seeds;

  • sulphites;

  • other allergens present in products supplied by third parties.

The exact composition may vary according to suppliers, available products and necessary substitutions.

The customer must disclose any allergy, intolerance or dietary requirement before placing the order or, at the latest, within the period specified on the booking page.

Upon request, L’Aube Parisienne will provide the information available concerning ingredients and allergens declared by its suppliers.

Unless expressly confirmed in writing, L’Aube Parisienne cannot guarantee the complete absence of traces of an allergen, particularly because of suppliers’ manufacturing conditions and the risk of cross-contamination.

In the event of a severe allergy, L’Aube Parisienne may refuse or adapt the food portion of the service when it cannot reasonably guarantee the customer’s safety.

The customer is responsible for communicating allergen information to all participants and recipients.

Article 11 – Cancellation by the Customer

All cancellation requests must be submitted in writing to:

The date on which the email is received determines the applicable cancellation period.

Unless specific conditions are expressly disclosed before the order:

More than seven days before the service

All amounts paid will be refunded in full.

Between seven days and 72 hours before the service

Fifty per cent of the amounts paid will be refunded.

Less than 72 hours before the service

No refund will be provided.

These retained amounts take account of products ordered, perishable flowers and food, preparation time, the reserved time slot and commitments made to suppliers.

Where circumstances permit, L’Aube Parisienne may offer a change of date or credit note, without being required to do so.

This cancellation policy does not limit the customer’s statutory rights where cancellation results from a breach attributable to L’Aube Parisienne.

Article 12 – Right of Withdrawal

Under Article L.221-28 of the French Consumer Code, the statutory fourteen-day right of withdrawal may not be exercised in particular for:

  • goods liable to deteriorate or expire rapidly;

  • goods made to the consumer’s specifications or clearly personalised;

  • catering services to be provided on a specific date or during a specific period;

  • leisure activities to be provided on a specific date or during a specific period.

Depending on the offer selected, L’Aube Parisienne’s services include fresh flowers, perishable food products, personalised items or an activity booked for a specific date and time.

The customer therefore does not benefit from the fourteen-day right of withdrawal for these services.

The cancellation policy set out in Article 11 nevertheless remains applicable.

If an exceptional service offered by L’Aube Parisienne does not fall within any of these exemptions, the consumer will benefit from the statutory right of withdrawal. The applicable conditions and withdrawal form will then be provided before the order is placed.

Article 13 – Cancellation by L’Aube Parisienne

L’Aube Parisienne may cancel or postpone a service in the event of:

  • unexpected unavailability;

  • a safety issue;

  • illness or a serious impediment;

  • failure of an essential supplier;

  • inability to access the location;

  • dangerous weather conditions;

  • force majeure;

  • any circumstance making the service impossible or dangerous.

The customer will be informed as soon as reasonably possible.

Depending on the circumstances, L’Aube Parisienne will offer:

  • a change of date;

  • an equivalent service accepted by the customer;

  • or a refund of the amounts paid for the service that was not provided.

Unless otherwise agreed, refunds will be made using the original payment method within fourteen days of confirmation of the cancellation.

Nothing in this Article limits the customer’s statutory rights or liability for damage resulting from a breach attributable to L’Aube Parisienne.

Article 14 – Weather Conditions

Some experiences take place outdoors.

Light rain, cloudy weather or normal seasonal temperatures do not automatically constitute grounds for cancellation.

Where conditions present a serious risk or make the service reasonably impossible, including in the event of a storm, a significant official weather warning, extreme heat, snow, ice or another identified hazard, L’Aube Parisienne may offer:

  • an adaptation of the service;

  • a change of location;

  • a change of date;

  • or a refund.

The decision will take account of available official information, local conditions and the safety of participants.

Article 15 – Force Majeure

Neither party may be held liable for a failure resulting from an event meeting the conditions of force majeure within the meaning of Article 1218 of the French Civil Code.

The affected party must inform the other party as soon as reasonably possible.

Performance of the service will be suspended for the duration of the impediment where it is temporary.

Where the impediment is permanent or postponement is not reasonably possible, the order will be cancelled and the amounts corresponding to the service that was not provided will be refunded.

Article 16 – Image Rights and Photographs

Participants are free to accept or refuse to be photographed.

Where the service includes photographs taken using the customer’s telephone, the customer remains the owner of the files stored on their device.

L’Aube Parisienne will not use any photograph that identifies a customer for commercial or promotional purposes without the customer’s prior, specific and revocable consent.

Refusal to authorise commercial use of photographs will not affect the provision of the service.

Article 17 – Conduct and Safety

The customer and participants must behave respectfully and prudently and comply with reasonable safety instructions.

L’Aube Parisienne may discontinue a service in the event of:

  • dangerous behaviour;

  • violence or threats;

  • excessive consumption of alcohol or other substances;

  • repeated refusal to comply with instructions;

  • behaviour that endangers people, property or the location.

Where the interruption results from a participant’s wrongful behaviour, no refund will be due for the portion of the service that could not be provided.

Article 18 – Liability

L’Aube Parisienne is responsible for the proper performance of its obligations under the conditions established by law.

L’Aube Parisienne will not be liable for damage resulting exclusively from:

  • the fault of the customer or a participant;

  • inaccurate information supplied by the customer;

  • failure to comply with safety instructions;

  • an unforeseeable and unavoidable act of a third party;

  • an event of force majeure.

The customer remains responsible for their personal belongings.

No provision of these Terms may exclude or limit L’Aube Parisienne’s liability in the event of:

  • gross negligence or intentional misconduct;

  • personal injury attributable to L’Aube Parisienne;

  • breach of an essential obligation;

  • application of a statutory guarantee;

  • any other situation in which limiting liability is prohibited by law.

Article 19 – Statutory Guarantees

The customer benefits from the applicable statutory guarantees, including:

  • the statutory guarantee of conformity provided by the French Consumer Code, where applicable;

  • the guarantee against hidden defects provided by Articles 1641 and following of the French Civil Code;

  • the rules governing the proper performance of services.

These guarantees apply independently of any commercial guarantee.

The natural, seasonal or perishable nature of a product does not exclude the obligation to provide a product that is compliant, fit for consumption or its intended purpose, and free from abnormal defects when delivered.

Any issue should be reported promptly and, where possible, accompanied by photographs and the relevant order details.

Article 20 – Complaints

All complaints must be submitted to:

The complaint should include:

  • the customer’s name;

  • the booking number or date;

  • the service concerned;

  • a description of the problem;

  • the solution requested;

  • any supporting evidence.

L’Aube Parisienne will acknowledge the request and seek to respond within a reasonable period.

Article 21 – Consumer Mediation

After submitting a written complaint to L’Aube Parisienne that has not resulted in an amicable solution, a consumer may refer the matter free of charge to:

L’Aube Parisienne’s membership is valid until 10 June 2029.

Referral to the mediator is voluntary and does not prevent the consumer from bringing the matter before a competent court.

Article 22 – Personal Data

Personal data collected may be used to:

  • manage bookings and payments;

  • organise experiences and deliveries;

  • communicate with customers;

  • comply with accounting and legal obligations;

  • handle complaints and prevent fraud.

Personal data is processed in accordance with the GDPR and the Privacy Policy available on the website.

Article 23 – Evidence, Retention and Confirmation of the Contract

Order confirmations, electronic communications, booking data and proof of payment may be retained in accordance with applicable regulations.

They may be used as evidence of the order and communications between the parties.

The customer is advised to retain the booking confirmation, these Terms and the information relating to the service.

Article 24 – Amendments to the Terms

L’Aube Parisienne may amend these Terms at any time.

The applicable Terms are those accepted by the customer on the order date. A subsequent amendment will not apply to an order that has already been confirmed unless expressly agreed by the parties or required by law.

Article 25 – Severability

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will continue to apply.

Where possible, the affected provision will be replaced by a valid provision having an equivalent purpose.

Article 26 – Governing Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, the parties will first seek an amicable solution.

If no agreement can be reached, the dispute may be brought before the competent courts in accordance with the applicable legal rules.

Where applicable, the consumer retains the benefit of the mandatory protective provisions of the country in which they habitually reside.
